"Criminal Behavior - Crime
& Punishment"
Everyone has their own
definitions of what a criminal personality might consist of that further
similarly matches the over all national consensuses most of the time. Let's
really dissect criminal behavior by examining some generally known definitions
of crime, criminals and the known behaviors of persons operating outside of our
legal system.
“The label of "crime"
and the accompanying social stigma normally
confine their scope to those activities seen as injurious to the general
population or to the State, including some that cause serious loss or damage to
individuals.”
“ Those who apply the
labels of "crime" or "criminal" intend to assert the hegemony of a
dominant population, or to reflect a consensus of condemnation for the
identified behavior and to justify any punishments prescribed by the State (in
the event that standard processing tries and convicts an accused
person of a crime)” http://en.wikipedia.org/wiki/Criminal_behavior
“Crime is the breach of rules
or laws for which some governing authority (via
mechanisms such as ( legal systems) can ultimately prescribe a conviction. Individual human societies may each define crime and crimes
differently” http://en.wikipedia.org/wiki/Crime
“In law,
a conviction is the verdict that results when a court of law finds a defendant guilty of a crime.”http://en.wikipedia.org/wiki/Conviction
“ Parole may have different meanings depending on the
field and judiciary system. Release of prisoners based on prisoners giving their
word of honor to abide by certain
restrictions. “ http://en.wikipedia.org/wiki/Parole
So basically a person who
lives out side of our state and national laws can be considered a criminal
personality. A person or group that causes harm, damage, pain or loss to another
person can be considered a criminal personality, correct?
A person that knowingly
and willingly commits criminal activities seen as injurious to another person by
a society. A criminal knowingly and wantingly commits the unlawful action
despite any laws enacted to prevent certain injurious activities against another
person.
Again, a criminal
personality can be construed as a person having the full knowledge of right and
wrong action but chooses wrong action out of lust, greed, self-gain or other
self-serving purposes.
"Premeditation , Motive And
Directive"
"Premeditation in order to
either increase the likelihood of success, or to evade detection or
apprehension."http://en.wikipedia.org/wiki/Premeditated
"Premeditated
murder is
the crime of wrongfully causing the death of
another human being (also known as
murder) after
rationally considering the timing or method of doing so, in order to either
increase the likelihood of success, or to evade detection or
apprehension."
"[1] State laws in the United States vary as to definitions
of "premeditation." In some states, premeditation may be construed as taking
place mere seconds before the murder. Premeditated murder is usually defined as
one of the most serious forms of homicide, and is punished more severely
than manslaughter or other types of
murder - often with the death penalty or a life sentence without the possibility
of parole.
So in essence, a person
can be considered a criminal personality via their track record of negative
behavior that further specifically moves against, or violates any part of the
established state and federal laws via premeditation, deception, malicious
actions and contemptuous behavior against a given person or group through
breaking any laws set in place to protect that person or group
.
Or in having a conscience
and rational plan to obstruct, offend and breach the civil liberties, or rights
of others within any given community. A person with total disregard of legal
guidelines set in place to keep the peace that moreover governs the civilized
society.
A criminal personality is
one whom lives within a community but doesn't abide by the rules and
regulations, or laws of that community. To openly defy the set laws of society
through contemptuous and often times violent behavior, or other types of
detrimental behavior geared to destroy or impede another's life in some
way.
Please read the
definitions below to further discern the differences between the criminal mind
from the what we consider to be calm and rational thought through deductive
reasoning.
Below, we have yet more
descriptions of what society considers normal set and typically the
psychological tools in which we use to lead a peaceful, productive and lawful
life yet, criminal personalities such Mary Prantil will use these same
psychological components to blatantly and premeditatedly break whatever laws
that inconvenience her in any way.
"Reason And Deductive
Capabilities"
"Reason is a mental faculty (or ability)
found in humans, that is able to generate conclusions from assumptions or premises. In other words, it
is amongst other things the means by which rational beings propose specific reasons, or
explanations of cause and effect. In contrast to reason as an abstract noun, a
reason is a consideration which explains or
justifies." http://en.wikipedia.org/wiki/Reason
"Deductive reasoning concerns what
follows necessarily from given premises (if a, then b).
However, inductive reasoning—the process of deriving a reliable generalization from
observations—has sometimes been included in the study of logic." http://en.wikipedia.org/wiki/Reason
"Correspondingly, we must distinguish between
deductive validity and inductive validity (called
"cogency"). An inference is
deductively valid if and only if there is no possible situation in which all
the premises are true but the conclusion false. An inductive argument can be
neither valid nor invalid; its premises give only some degree of probability,
but not certainty, to its conclusion."
http://en.wikipedia.org/wiki/Logic#Logical_form
In short, criminals like
Mary Prantil use and abuse whatever they can to manipulate, deceive or disrupt
for self-gain. Criminals are anything but insane even though the try to come off
as so and further have a strong sense of self-preservation.
Why wouldn't a person
whom abuses everything in life look at our laws or compassion as being sacred?
Why wouldn't they use the insanity defense to avoid harsher sentences or the
death penalty? See articles below.
"Sanity And Mental Illness"
"Insane "insanity" n. 1)
mental illness of such a severe nature that a person cannot distinguish fantasy
from reality, cannot conduct her/his affairs due to psychosis, or is subject to
uncontrollable impulsive behavior. Insanity is distinguished from low
intelligence or mental deficiency due to age or injury.
If a complaint is made to
law enforcement, to the district attorney, or to medical personnel that a person
is evidencing psychotic behavior, he/she may be confined to a medical facility
long enough (typically 72 hours) to be examined by psychiatrists who submit
written reports to the local superior/county/district court.
A hearing is then held before a judge, with the
person in question entitled to legal representation, to determine if she/he
should be placed in an institution or special facility."
http://legal-dictionary.thefreedictionary.com/Legally+insane
Miss Prantil was remanded
to Rikers Island woman's prison twice for psychological evaluation to establish
her sanity after carrying out numerous breaches of common law along with
consistently violating the civil rights of several other persons over a three
year cycle.
Of course you can see by
the insanity definition above that she's not legally crazy although she tries to
come off as so, she can escape real prosecution however, it won't work in this
case as I know the guy prosecuting her and he's no dummy.
According to the
description definitions above outlining the symptoms of insanity and criminally
insane, both state that a person has to meet the specific criteria in knowing
wrong from right and moreover have the capability and reasonable control in life
to handle any daily events that might arise etc.
In short, to be able to
reason things out regarding the pros and cons of any situation or event and
further, what can be done to better ones chances of success in either overcoming
a problem, or achieving a goal of one kind or another.
This is viewed as problem
solving to which is considered to be a positive or productive attribute however,
when taken in excess or perverted, we understand it to be negative manipulation
especially when it comes down to using and twisting factual, or flatly lying
statements to misrepresent a situation for self-gain.
Moreover to use the
powers of observation, manipulation and planning to work damage to a otherwise
peaceful person in a orderly situation. The criminal creates loss and
destruction for self-gratification, self-gain or to build upon a person's
narcissistic belief in themselves as this would be the only way they could feel
validation for existing, such as in the Mary Prantil case.
If the truth be known I
would say that the criminal personality possesses a huge portion of egotism on
the side, coupled with the fact that even though this type of person believes
themselves to be overly intelligent they are not, as the prison populations show
to date.
So in essence, we have a
person with low, moderate to a high level of intelligence at times who enjoys
playing the system, and moreover beating the system whenever possible. A person
whom enjoys the thrill of committing a criminal act for the sake of taking
something by force or intellect, this can be considered a predator of one kind
or another.
This is far from someone
who has been legally diagnosed with insanity. Why? Because no matter how small
or great the crime turns out to be, it takes a certain amount of planning and
skill in pulling it off. This inevitably means that a person must retain a
certain amount of psychological faculties or dexterity of mental process to plan
and carry out whatever actions etc.
"Crazy Or Not ?"
In other words, you can't
have your cake and eat it too. Your either a sane rational individual who lives
your live according to what's actually going on around you or you don't. In
fact, it's really impossible to be a sane and rational person one minute and a
crazy nut the next, in my opinion as a layman.
Again, a person can't
have the ability to take care of themselves personally and further, their over
all affairs one minute and then become a mindless idiot the very next minute, or
incapable of handling the world of reality as it's commonly perceived by
most.
Now that we've established what sane rational behavior can be
construed as from unstable, or what society considers to be irrational or insane
behavior let's move on to excessive behaviors be they negative or positive in
nature.
Let me just say that the
laws of any governing body only reflect the mass view, or sentiment of the mass
majority of the population and thus, laws are born out of a need to create
order.
When person moves against
the laws of the governing body then it is that same person moving against the
established order of society, or against everyone holding membership within that
civilized structure.
This brings me to my next
point. Please view the definitions and descriptive meanings to the criminal
charge felony and misdemeanor immediately below to better understand how society
looks at, and defines various criminal acts, or what is considered constituting
a given criminal act.
- "Differences Between Felonies
And Misdemeanors"
- "The common law divided participants in a felony into four
basic categories: (1) first-degree principals, those who actually committed the
crime in question; (2) second-degree principals, aiders and abettors present at the scene of the crime; (3) accessories before the
fact, aiders and abettors who helped the principal before the basic criminal
event took place; and (4) accessories after the fact, persons who helped the
principal after the basic criminal event took place. In the course of the 20th
century, however, American jurisdictions eliminated the distinction among the
first three categories." Gonzales v.
Duenas-Alvarez, 549 U.S. 183 (2007) (citations
omitted)”.http://en.wikipedia.org/wiki/Felony
In some states,
felonies are also classified (class A, B, etc.) according to their seriousness
and punishment. In New York State, the classes of felonies are E, D, C, B, A-II,
and A-I (the most severe). Others class felonies numerically, e.g., capital,
life, 1st degree, 2nd degree, 3rd degree, state jail or class 1, 2, etc. (VA).
The number of classifications and the corresponding crimes vary by state and are
determined by the legislature. Usually, the legislature also determines the
maximum punishment allowable for each felony class; this avoids the necessity of
defining specific sentences for every possible crime”.http://en.wikipedia.org/wiki/Felony
A felony may be punishable
with imprisonment for one or more years or death in the case of the most serious
felonies, such as murder.
Indeed, at common law when the British and American
legal systems divorced in 1776, felonies were crimes for which the punishment
was either death or forfeiture of property. In modern times, felons can receive punishments which range in
severity; from probation, to imprisonment, to execution for premeditated murder or other serious crimes. http://en.wikipedia.org/wiki/Felony
"Why Do People Break The Law ?"
Why do people decide to go against
society and its laws? Well, some folks outside of the reasons stated above will
commit crimes because they view it as way to exert vigilantism justice, a means
to fulfilling a greedy need, to exert control over another, lack of
self-control, wanting to take the easy way out and a multitude of other
different reasons.
I think, we as a society also
misinterpret the hostile acts of others to be insane via their criminally
destructive accomplishments or attempted goals however, I believe this is
anything but insanity and more to do with serious depression, confusion,
anxiety, loss of hope and over all excessive “I don't give a shit attitude”, or
disregard for the governing laws of a community, state or federal
government.
As a rule of thumb, misdemeanors are
crimes against the state and felonies are crimes against the federal government
however, no distinction is made by most criminal personalities as the goal exist
at the moment without fear of repercussion.
This actually comes from the
personality feeling that they are smarter then everyone else and that their
chances for capture are slight if any. Again, the criminal has reasonable
suspicion that something could go wrong within the process of the crime and this
further show foresight and planning on their part.
For example: from the Arizona killer
writing on a blog page, "Good Bye dear friends" . "What would you do if
imprisoned" etc. Yes, this person sounds a little spaced out yet, he considered
the ramifications of his future actions.
In the hypothetical situation or event
that a person feels slighted by society, family or friends, that further decides
to lash out at society in the way of committing a crime against the state or
government may indicate emotional upset concerning one's life yet, this is a far
cry from insanity lol.
"Arizona Assassin"
In the case of the Arizona incident we
have a individual that felt slighted, or wronged whom moreover chose to
undermine the system open to receiving grievances for peaceful resolution.
Instead of venting his grievance against a person, or government body through
the proper channels he chose to act out in a criminal way by committing several
directed and indiscriminate assassinations.
Again, a directed effort in
assassinating certain political leaders without regard to any innocent persons
that might be around these certain political targets. Perhaps there were no
innocent persons as far as he was concerned and thus, he basically viewed the
entire crowed around the Judge and Governor as sympathizers equal to the persons
targeted for the assassinations be they old or very young.
Again, in the Arizona incident, the
perpetrator’s premeditation has been established on the grounds of planning,
literature and enacting of the actual capital crime of multiple homicides. I
hope the courts will judge this individual accordingly along with any other
subjects who follow suit in committing crimes of this nature.
We as a society or nation of people
need to recognize the differences between people whom are fully insane from
those who for whatever reason decide to become disruptive in exerting their own
brand of twisted and unlawful injustice against another for whatever
reason.
"Looks Can Be Deceiving"
For example, If I went out and chose to
drop my pants on the street corner in a big city some place, would this mean
that I was crazy? What would be the extenuating circumstances to that event and
would folks take the time to discern what was actually going on?
If I did something like this would mean
that I wasn't looking at, or maybe didn't care about the repercussion of such an
act? Yet, this would seem crazy to most persons that happen to have witnessed
the event even though I knew exactly what I was doing.
Perhaps they observed me looking down
and screaming at the ground during this event, would they write me off to being
like the cart lady that has arguments with herself.
Another scenario could be as follows:
Perhaps a mouse ran up my pant leg and I had to remove my pants quickly in a
effort to remove the rodent. Maybe I became a little concerned in what was
crawling up my leg and began slapping at it. Basically, all the witnesses sees
is my pants coming off in a inappropriate place while observing me jumping and
down all over the place lol.
All I'm saying here is in that we
shouldn't always be so quick to judge as what we think we see at first glance
because this isn't necessary what's really going on in some cases. What we see
at night looks very differently in the light of day. In other words, some times
mental instability has absolutely nothing to do with a evil act and moreover,
that some people are just nasty, or purely evil by nature.
It's a fact of life that we have those
in our communities that really don't care about our laws, or the long term harm
they cause as a direct result of their own selfishness and stupidity. Some folks
are just like animals and don't deserve to live within any ordered society, in
my opinion. I'm sorry to have to say this at the risk of sounding callus but it
is, what it is.
We, as a free Nation have the ability
to weed out the criminals from our communities through our participation in the
governmental process, or in petitioning for new laws to address new issues we
find ourselves confronted with. To close the loop holes in which the criminal
element crawls through.
By doing so we can leave our legacy of
a safe and peaceful land to Americas future generations. Why should we make
excuses for the criminal? Or leave them for our young to deal with?
Why give civil rights to a person who
cares nothing about the civil rights of others? Why tolerate the criminal
element within our communities, or show compassion to those who’s only dream is
to feed off of society likened to parasites?
To make excuses for the criminal, or
give them a way out by offering them the insanity plea is in itself a insane
proposition. To afford the criminal the very same civil liberties we bestow upon
the law abiding, or main body of society is preposterous. This is absolutely
disastrous and the kind of thing to which has come back to haunt us in the
present.
When a subject commits a crime against
another to any degree then they commit that offense against all of us, moreover
against our entire nation.
Two bit criminals like Mary Prantil
right on up to mass killers like Jared Loughner are anything but Americans in my
opinion because in both instances, they've given up their rights to be as such
through their criminal acts against society.
The folks in these two instances still
have the moral rights to a fair trial and to be treated humanly however, this
doesn't mean that we have allow them to continue to abuse our laws by hiding
behind them, or using these same laws against us while incarcerated such as
tieing up the courts for years on end via frivolous motions for continuance,
stays and appeals etc.
America is an ideology built upon a set
of established moral principles to which are translated into its laws governing
a state of democracy, social order and civil rights. When the criminal defies
these very laws, then they in turn defy the basic ideology and principles that
America stands for and was built upon in the first place.
Thus, the term “UN-American” can be
applied to a criminal personality. When the criminal such as Mary Prantil
abuses, bends, or breaks such laws as free speech through deception, twisting
and lying to the public in a effort to cover up her criminal activity, then this
in itself shows absolute malice towards American laws and values.
Prantil can be considered an absolute
enemy of the state, federal government and society over all as far as I'm
concerned. This applies to anyone who would infringe, harm or blatantly violate
the civil rights of innocent others be they in the private sector or political
arena.
"Criminals Playing The System Verses Legal
Rights"
Everyone has the right to
due process of law, even upon conviction by a state or federal court system
however, if a subject has a track record for violence with prior convictions
they should have certain legal rights reviewed and retracted in some instances
according to the circumstances of that case, or offense.
In other words, the early
release of a convicted criminal such as Mary Prantil should have long term and
enforceable restrictions, or sanctions placed against her via limited to no
access to electronic medium exchanges upon release.
Again, especially when
you have a person like Prantil that has been tied up in the courts for roughly
three years for the same repetitive offenses carried out against several
different people over and over again.
This is the criminal
openly thumbing her nose at the legal system, wouldn't you think? When
criminals become this comfortable with the system that they have no problem in
openly abusing the system, we have a problem.
Especially in light that
Mary Prantil uses these certain mediums such as phone, email and Internet to
procreate crimes of aggravated harassment, communicating alarm, and slander to
harm personal reputations and the good names of online businesses while she's
waiting for her next court date, etc.
Upon conviction and
sentence the civil rights concerning freedom of movement, and out side contact
should be restricted as is currently in place pertaining to correctional
facilities regarding inmates serving out a sentence.
Other human right issues
should be observed such as providing medical treatment and security for the
convicted person such as in keeping them clean, fed, clothed and safe from other
inmates, but this is where it stops as far as I'm concerned.
I believe that once we
have a person with a troubled past, whom is a long time repeat offender like
Mary Prantil is taken into custody, they should not only be made to serve their
full sentences but be closely monitored for a period of five years upon their
release. Or to be placed on a strict, no nonsense and highly controlled
probation setting with a no tolerance policy concerning the terms of that
probation.
I just don't believe that
tax payers should shoulder the unnecessary expenses for a prisoner's educational
programs and other frivolous programs offered to the inmate while
incarcerated.
I don't mind shouldering
taxes for correctional programs that both keep violent persons off the streets
and further continues to keep a close check on inmates out on early release as
this only serves the healthy growth of our society.
Of course, you know my
stand concerning violent offenders such as persons found guilty of capital
murder. Lock them up, try them, and act appropriately in ridding society of
this menace.
I also believe that
offenders that commit acts of rape and other types of sexual predators should
have very long and enforced prison terms.
Child pedophilia is
ranked with murder in my opinion as these predators pry on the weakest in
society being our kids. Besides, it's been proven, and admitted by certain
pedophiles themselves that rehabilitation doesn't work.
"Health Care System"
Concerning the health
care system, I'm not really keen on the passed law concerning the mandating of
forced health insurance, but this is a discussion for another time. I will say
that we as a people should support government in the way of maintaining our
institutions for both the insane and the hardened criminals.
To bear down on
government for the sake of lessor tax only causes governmental cuts that are
much needed in the way of maintaining a smoother running society. A medium must
be found between what works for government and society and more so what
doesn't.
When the government
attempts to cut away much needed programs that keep America safe such as
defense, law enforcement, and other institutions to house the mentally ill, it
only stands to reason that we the public will have to deal with these problems
such as what were dealing with currently. Build it and they will come
lol.
"What Will Happen In Future Days To
Come"
Currently, we as a Nation
are experiencing the break down of society, as shocking as this sounds it is a
reality unfortunately. This is something that started back in the mid to late
sixties with the moral, value and standard decline or break down in our value
system to a lessor extent.
From there it progressed
on in doing away with certain taboo's and moreover our morals or standards
became more lacking as a result of our tolerance to things that wouldn't have
been acceptable to us previously.
Yes, there were things
that needed to be seriously addressed in the sixties and seventies regarding
human rights, racial equality along with gender fairness issues however, it
didn't stop there and we went off into what's known today as the social
decline. We over shot and became excessive with our good
intent.
Like all good things the
U.S. Constitution was a good thing in the beginning as it is now, that outlined
the stipulations for fairness and equality moreover, was the blueprint for a
free and unobstructed way of life.
But like anything
humanity does, we move to the excess. We are a unbelievably compassionate
society, so much so that it actually works against us at times. We are a
forgiving society yet this has worked against us at times, or more often then
not.
We eventually look for
ways in fixing or improving things that don't really need fixing or improving
upon such as various previsions in the Constitution. The ironic thing here is,
that while were fixing or modifying these issues of constitutional rights we
often times end up ignoring other areas that need immediate updating in our
various laws, and or civil laws.
We give violent criminals
the rights to buy and bear firearms, stalkers the right of freedom of speech and
movement to stalk, and other means to harass and torment others through. We
think nothing about giving pedophiles and other sexual predators the right to
find work wherever they may even if this means infiltrating a school or church
by moving out of state, etc.
It was the excessive
lobbying by the human rights activist that ultimately ended up tieing our hands
in safeguarding our society with updated laws designed to protect or safeguard
the public. It was these same laws that prevented us from running an extensive
background check on the Arizona shooter when stopped by the police hours before
he carried out his criminal acts.
Our society is in a tail
spin currently and lacks the proper laws and moral guidance from church and
state. The American dream for many doesn't exist because of inflation and the
lack of employment opportunities that shouldn't be a problem at
all.
Our governmental body
seems to be having communication problems and a reasonable amount of difficulty
through conflict in finding a way to efficiently work with one another. It
doesn't matter who's the Democrat, bipartisan or republican, right? The
government is the government, correct?
It doesn't matter who's
on the right or left, or in whom is considered to be on the right or left winger
however, what does matter is that we all put our differences aside and work
together to get ourselves out of this mess.
Think about this for a
moment and ask the question; what would America's enemies wish for the most?
And what better way to bring down a nation? ( conquer and divide). Would our
foes delight in a given nation clasping in on itself without firing a shot?
Unfortunately, this is what's taking place in America right now as we
speak.
Again, it would seem that
there's a misunderstanding, or good concept of government leading by example the
way I see it. Don't you think this would be a good place to start? Moving on,
until we as a nation find a way to recognize and detain certain individuals on
the grounds of mental illness or criminal intent, were going to have serious
problems no matter how we slice it.
Until we can pull
together and work in a combined effort to resolve our national problems through
personal sacrifice and hard work, I believe that were going to have an increase
in these shootings incidents in future days to come.
When our politicians
saber rattle and moreover contribute to the violent extremist sick views via
leading or hostile speech against their political opposition, then there will
always be someone out there that will use this to claim the world is at it's end
moreover, while using this as an excuse to hasten the process along much as Jim
Jones, Charles Manson and David Karesh ended up doing for their followers any
way.
"A House Divided Can Not Stand"
Even Abraham Lincoln
understood that a government divided against itself will not prevail, or stand
for any length of time. When we have open conflict in coming from the very
foundations of our government leadership this only inflames and provokes the
distortion of criminal factions. Why? Because they take it as a call to action
as crazy as this sounds.
It doesn't matter how
demented their cause or perception of cause seems to be, or what political
motives drive them on. These sleepers awake and find a cause in making a violent
statement to the world as a result of something they've heard coming from
someone they hold in authority.
In short, a strong
government is a strong society. A informed society with a unified resounding
voice at the polls makes for a strong and efficient government. It all starts
with that person looking back in the mirror at you. Thank you so much for taking
the time in reading this and hearing one voice out of many.
