The U.S Constitution was specifically designed and
written by our countries forefathers around the times in which they
lived and there of, outlining several resolutions for the societal
problems that they faced in that day.
Well, it has been quite some time sense we've really
updated the Constitution simply because everything seem to be working
rather well, until now. Until some started abusing the civil the
civil right of other in a most serious way especially over the
uncharted internet.
Sure, we've made some adjustments to it over the years
however, even these sub-provisions to the amendments are growing
obsolete and need further updating in themselves concerning the
serious problems we now find ourselves facing currently.
I personally believe that there's a few areas that
should be caught up to date regarding our constitution such as the
first amendments right to free speech is holding a person accountable
for what they say or project over a mass medium to the public.
The first amendment shouldn't be
changed in the way of inhibiting any part of free speech or
expression, but in holding a speaker or author liable for the speech,
writing or music they generate in the course of free speech and
expression that further effects the public in any way, shape or form.
If the speech, visual art, or sound adversely effects
any part of the societal whole then they the author shall be held
liable to any harm that it might cause.
Is this censorship? No, because it's not a state or
government hindering the speech even though the ramifications for
damage or harm might be coming from that particular or government.
However, it does place the choice, responsibility and
accountability back in to the arena of the artist, writer, producer,
author or speaker in what they generate such as what the public might
read, watch or listen to in the way of entertainment or political
statement.
This sounds like censorship at its worst however we as a
society need to start thinking about what's not only good for us and
our children but what is beneficial to us as a country.
Produces of any movie or script writer should make sure
in the message that their trying to convey doesn't have any room left
in it that can be misconstrued, and the same goes for song writers
and what a politician might say to the public.
We as a nation have to understand that the common person
looks up to us, idolizes us, mimic us in every way. Watch the
children and see how they mimic our actions be they in private or in
the public eye and realize that like kids, some adults and young
adults are impressionable. In other words, some things are left
better unheard or unseen by some.
The F.CC, was at one time the safety catch back in the
60's 70's 80's and 90's however, it would seem that they have their
hands tied up these days in light of the constitutional disputes of
free speech and the civil suits that have been brought against them
as a result.
Let's face it, not everything someone creates
artistically, or speaks out on needs to make it to the air ways, book
shelves, stores or on the internet. Why? simply because it's purely
harmful and down right evil in some cases, or has a advert negative
effect on certain segment of the populace.
Quite honestly, certain art work, speech and melody or
song really shouldn't be looked at as free speech or constructive
expression especially when it crosses the line of harmful or invokes
untruthful speech, death threats, inciting violence, or even death,
commuting or inciting intolerance, inciting violence through violent
image, writings, video or suggestive lyric.
Yes, we can tell ourselves that negative speech or
expression is all good and further continue to allow this detrimental
expression for the next 200 years, Or we can use our common sense in
having the realization that some of this trash is actually advert, or
extremely harmful to us as a society, and further against the very
American values that we hold so true.
In short, just because someone wants to preach hate and
intolerance toward gays, blacks, whites, women of foreign nationals,
It doesn't mean that we have to condone this sort of thing by making
it legally possible for hateful persons to vent these various forms
of intolerance and hatred not only over the internet but on the
various platforms in our cities as well.
When we give organizations like the K.K.K, Skin Heads or
a person like this reverent Phelps a podium to preach his hate from,
and further provide him a place to peaceably assemble, then were
condoning and promoting these given groups through inaction or
improper action. Hate and intolerance should be unlawful no matter
the form it takes.
Let me ask you something, If you were to see a picture
of a young person hanging themselves on the Internet would this serve
your mental health in any way? Or what if you heard a song on the
radio advocating the beating of females and children, Would this
serve your emotional growth in any way?
Let me further ask you, If you had someone talking trash
about you over the internet just because this was their right of free
speech, a way for them to vent their intolerance and hate against
your race, life style or religious background, is this what's
considered to be free expression? Or is this violation against a
persons civil rights that could possible be a precursor to a criminal
act in some cases.
Would this not bother you in some way? Would it harm, or
serve your emotional or spiritual growth, and is it staying true to
the Constitution in guarding your civil rights? And what about any
others that might be subjected to this negative content both adults
and children alike? Does it serve them in any way? This is all
currently going on and allowed under the right to free speech and or
the freedom of expression.
I also believe that distinct or specific language should
be implemented in the separation of a given certain amendment from
that of other federal laws in light that some would take certain laws
and bend their meanings from the actual intent of that particular
law.
Case in point, grouping and applying the first amendment
right of free speech and or, the freedom of expression with other
later formed federal laws such as the Federal Whistle Blowers act and
Federal Communications Decency act.
In this instance, wouldn't you find this to be a
convenient way to not only bend federal and civil laws to your
liking, but go on to profit financially from such laws? It is through
this practice of taking a law out of context, twisting and abuse that
opens such laws up to even more eventual abuses and this is why we
must close the loop.
Of course this has a lot to do with those on the
internet mostly in their twisting and abusing of these certain laws
that moreover really have nothing to do with the original writings in
the Constitution over all, or the first amendment in it's proper
context, as far as I know. It's all about exploitation and financial
gain for some and noting is safe as a result.
In this last instance some have decided to compile these
three federal actions together in the so called names and pursuit of
excising their constitutional rights of free speech and expression,
yet profiting through their abuse and further nose thumbing their
contempt at the law makers etc.
When the F.CC, or over all federal
government allows others in carrying out these types of activity,
they are in turn allowing, condoning and promoting certain persons in
violating the civil rights of unknown countless other people on the
internet and in private or off line.
This
last paragraph is primary directed at what we know as the gripe sites
or scam sites such as Rip Off Report found at www.ripoffreport.com
. This site and others like it can be considered the perfect storm
consistently made up or composed of slander and liable. It's sites
such as this that lays the ground work down for the daily violation
of civil rights through the perversion of state, federal and other
constitutional laws.
To give unlimited reign to free speech, or to yield the
rights to free speech without liability is simply not prudent on any
level. The internet is really a problem that needs immediate
attention because it's through free speech mainly, that hateful acts,
intolerance and violence is carried out through various abuses, as
you've read above.
When we fail in placing safety catches on free speech in
the way of liability for what one says then this in itself lets the
Genie out of the bottle. The challenge here, is in moderation
concerning the safety checks without inhibiting productive free
speech, or the right to speak ones mind in the way of constructive
criticism and self-expression.
So, In order to make everyone stand behind their
statements both on the internet and land bass we would have to start
by enforcing legal liability on those in the public eye, or having
anything to do with the public.
Next, we hammer down hate speech and other forms of
speech, or expression that procreates a negative sentiment, or
physical harmful out come to others through making examples of the
offenders with heavy fines and possible extended jail time.
We as a society have no problem in pursuing, arresting
and imprisoning sexual predators be they convicted or not and yet,
They view their criminal activity in the way of child pornography as
a form of art and expression.
They obviously further feel that they have the right to
express or share this filth with one another. Yes, we do catch them
locally and arrest them at times but what happens when they go
national or internationally over the internet? Answer, Not much. Does
this not pose a problem and violate the rights of children? The very
right to grow up in a safe environment free of sexual predators.
We have folks in this country advocating cannibalism and
a whole bunch of other grotesque causes subject matter while excising
their rights to free speech, would you want someone like this living
next door to you? Well, their right down the street from you.
We view the white supremest statements as free speech
and moreover yield them the right to peaceably assemble in our
cities, that is until it turns violent or deadly. We allow other
racial groups the right to assemble as well while projecting their
hate and intolerance on the public because we want to be fair to
everyone, we want to be politically correct, right?
Do you really think our founding fathers had all this in
mind when drafting up the United States Constitution? I don't think
they had a clue, if you ask me. In fact, I believe that if they could
be present here with us today they would most certainly snatch their
quail pens up and start making a few changes right off the bat.
Again, it basically comes back to common sense when it
comes to your free speech and the right to express yourself, but like
anything else in the world, there will be criminals whom only seek to
pervert and abuse even sacred things not to mention our
constitutional laws. They abuse and twist everything for reasons of
self-gain or profit.
Folks such as this can be compared to criminals likened
to Prantil who only screams about her civil rights when she can't
profit financially or twist them in a effort to cause loss or pain to
another human being.
Criminals great and small only care about our laws when
they can use them to their personal benefit and so, when the law
becomes inconvenient to them they have no need for our laws. Why
should those of us that play by the rules care or include persons
like prantil or other criminals likened to her be given the same
protection we have? Answer, they shouldn't.
We are 300 million strong as a nation, we are the
majority and the criminals are the minority and this should cause
them concern.
There's a great number of us who still believe in the
old values of proper living ranging from those in the entertainment
industry, law enforcement, political arena and various forms of
media, civil rights and humanitarian organizations who I believe will
take a stand against these problem issues and win.
I also believe that main stream media will play a Hugh
part in all of this social and political reform simply because they
have retained a high standard of professionalism along with a healthy
and respectful view of the first amendment along with many other
groups, in my opinion.
I really think the internet world could take a lesson or
two from the media platforms such as the White House Press Core,
C.N.N, A.B.C, H.B.O and the B.B.C just to name a few of these
exemplary news agencies to numerous to mention here. I believe these
forms of media to be the voice of reason that will eventually pull us
all together in the common goal, what do you think?
Liability
And Penalties To Free Speech
Just because a person has the ability and right to speak
their mind doesn't mean that a person can say or vent their opinion
without grounds, or some level of fact backing up that given opinion,
ethically and morally speaking.
Just because we hold the right to speak our minds
doesn't mean that we have the legal right to call and leave death
threats on the answering machines of public officials, that we
ourselves may or may not have placed into that particular office.
We don't have the legal freedom to throw bricks or
threaten to catch homes a blaze just because we don't agree with a
certain stand someone makes. Yes, agree to disagree as time has a way
of solving the disagreement for us.
Yes, freedom of speech and unproductive criticism should
have real liabilities to it that further has financial and loss of
freedom repercussions as well. In our case, freedom of speech has
allowed a fruit loop stalker to harass and slander us for four years
now, this shouldn't be happening yet, it does all over the country
and to many others besides ourselves.
When someone promotes hate through destructive speech we
can safely say that it eventually leads to violent out comes in some
instances, it causes adverse health conditions and other
non-productive things as well. It moreover allows the violation of
civil rights supposedly guarded under the Constitution that seemingly
go unenforced.
Again, in our case, and in the many other cases similar
to ours, free speech is abused and turned into a viable weapon that
can, and has been used to violate not only our civil rights but lead
to other actions geared to destroy a life, business or over all good
name. Fortunately, our stalker is not very bright and fails all most
100 present of the time lol
So in essence, on the premiss that our laws of free
speech are vaguely set up though the constitution, I would surmise
that it directly contributes to the harassment of others along with
allowing other statements to be made that are intrinsically harmful
or counterproductive to a ordered society.
Free speech, or the right to express ones self should be
limited to productive statement of fact and stooped at
counterproductive mug slinging, ungrounded accusations or any thing
there after that can be construed as harmful or imminently dangerous
to any part of society both physically or reputation wise.
Stalking
Through Abusive Speech And Penalties
Regarding the issue of stalking be it over the internet
or land based stalking. Stalking while abusing free speech over any
electronic medium having to do with internet specially, should
constitute a felony on the highest level and further be equal to
other more serious charges such as hacking or internet fraud.
Moreover the misapplied laws of anonymity should be
completely done away with regarding the internet as this was a law
enacted to protect federal witnesses concerning the witnesses
program, it has nothing to do wit the internet. The federal
electronic decency act should be modified in holding mandated
liability to the site owner for whatever may be posted on their sites
in the way of statements, much like a news paper or television
broadcast of news content.
Again,
this law is abused and perversely twisted in its application on the
gripe sites such as www.ripoffreport.com.
The site cited previously has absolutely nothing to do with the press
media and further are more or less breading grounds for hate and
intolerance for profit under the guise of free speech and whistle
blowing.
This is another abused federal law as if a person is
posting untruths on a particular site against another then how is
this perceived as blowing the whistle from open online slander. If
I'm not mistaken, wasn't this law something to do with federal
employees turning in acts of corruption against a federal office? How
does this apply to the internet or a gripe site?
Concerning land based stalking, I would say that the
constitution affords a person the freedom of living their life in a
unobstructed way to pursue liberty, prosperity or over all happiness
in life and thus, stalking by another impends this process through
the victims fear of imminent harm or persecution coming from the
stalker etc.
In short, the free speech and movement of the stalker,
that is by action or behavior, an abusive act in victimizing of
another, should be looked upon as the violation of the civil rights
of the victim in question. I believe that stalking actions such as
this should be made a liable offense under federal law and taken out
of the realm of misdemeanor offenses.
Of course, heavy fines should be mandated for first and
second time offenders and periods of incarceration for repeat
offenders. Stalking on whatever level isn't a joke guys, and further
should be upgraded to a federal level simply because it seriously
impedes, obstructs and contributes to quality of life.
The abuse of any form of communication, or media via the
commission of this crime should be recognized as counts, as is all
ready in practice in some states.
Politicians
carrying firearms -An Act Of Desperation
I had tuned in to C.N.N one evening and began watching a
report mentioning that a head of state or two were considering, and
proposing in one instance that they were going to start carrying of
concealed weapons for personal protection, not only for personal
protection off the clock but during working hours as well.
I agree with them in that they should all start carrying
some form of protection however there are certain liabilities that
have to be considered before doing so.
This is a act of despotism born out of deluded or
weakened laws, or no such laws on the books in addressing the safety
of political persons holding various offices currently. In essence,
laws in addressing hostile speech coming from others against
congressional or senatorial members that induce immediate fear of
imminent harm or death upon them or their families.
Recent death threats have been subsequently, or
allegedly had been made against certain political members whom are
currently holding offices in high government and as a consequence has
brought yet another issue up that our laws haven't properly addressed
adequately enough, or not at all in some instances.
Especially, when it came down to unknown persons using a
given medium such a telephone to directly convey what they, or a
victim perceived to be as a real threat to personal well being or
personal safety to self and family members etc.
These political persons are now finding out that laws in
play that safeguard the presentational office from hostile speech and
or action do in fact place limitations on free speech indirectly via
harsh consequences to unproductive or threatening speech and or,
death threat via any form of medium.
laws restricted and designed to protect the presidential
office and the inhabitance therein that don't really extend to, or
protect other government bodies, or society on the whole, at this
time any way.
People consider carrying, or do in fact carry firearms
for many reasons however, the primary reason is in that they don't
feel safe with a current set of laws, or in that their engaged in a
high risk security job setting that requires a sidearm for personal
safety etc.
Most private folks carry weapons because they feel that
certain laws aren’t outlined in such a way that protect them in a
sufficient way and thus, they take on this responsibility personally.
I believe this to be the case currently concerning political
personnel wanting to carry firearms for personal protection during
work hours.
What makes matters even worse in this case, is when
political fugues are trying to do a job only to find that someone has
thrown a brick through the windows of office or home with a nasty
message attached to it. This isn't a good thing and further suggest
loss of control and mass archery. More in this topic under gun

Freedom
Of Speech And Religion
Like the freedom to speak your mind, or to exsert your
opinions on a public platform be it over of electronic medium, or in
a assembled group setting, common sense and values apply here as
well.
Yes, we have the right to define and practice our
religious beliefs under the existing federal law as long as it
doesn't impose our beliefs on, or go against the well being of
others. Anything that promotes hate, intolerance or tyrannical
behavior isn't spiritually backed no matter what a person says in
defense of their actions.
The key here is: “Don't impose your
views or beliefs on others” , To hold a given ideology
or spiritual value, or set of values within a faith system is one
thing as it only effects a person or group directly through their
personal choice.
In other words, Some parts of Islam shouldn't impose
their system of belief on a Christian group and the Christian
organizations shouldn't be moving into a Islamic system of faith in
their own land especially, while pushing their system of belief onto
unreceptive persons.
In the matter of belief and faith system, It's a
ideology formed out of personal experience and the belief therein of
a given unfolding of events, further relayed by the teachings of a
proclaimed leader of that particular faith system and more so, what
merit the followers bestow to that leader in the way of spiritual
accomplishments.
So, religion and faith systems are beliefs that change
with changing circumstance in a persons life no matter how dogmatic
the system may or may not be.
Further, it would be egotistically charged to believe
that one particular way or faith was right over another not alone
starting up holy wars over the ideology in question simply because
the two factions could not, or would not succeed in convincing the
other of who was right and who wasn't.
Subsequently the question remains “If the tree falls
in the forest did it make a sound if no one was around to hear it”
Matters of faith and religion can not be discerned with fact or
reason but thrive through faith in a perceived occurrence.
Faith is speculation, summation and theory based on
ancient documents in some cases. Textual content put fourth as a
guide for proper living that moreover yield the basic in depth
instructions and resolutions for a given problem that a society may
or may not be experiencing.
I hold true to my own personal observations that
spiritual faith and a belief is something higher then yourself by
whatever name known, It is by its very nature or ideology something
that works towards both a spiritual, societal and environmental
harmony on whatever level.
Positive Spiritual values no matter the system works to
promote success and longevity not only on a personal level but on a
community level through subscribing to a set of spiritual principles
designed for self-preservation and global peace.
And thus, a spiritual belief by its very nature should
invariably be adverse or opposite to promoting hate, intolerance or
violence to any degree and on whatever level.
So in essence, if a group believes in war and violence
in the name of Divinity, then that group hides behind spiritually as
a false faith system, or under its guise to incite violence in the
name of God. To accomplish an evil task in the name of good.
I believe that the spiritual views along with other
positive values should be promoted in the schools yet, I also believe
that fair time should be given to all brands of non harmful spiritual
pursuit including non-spiritual groups such as agnostic or atheistic
views as they have something valuable to offer, or contribute as
well.
I know this will never happen as most are anchored in
their dogmatic views and there for, won't afford our young in making
up their own minds about things of a spiritual nature. It is also by
this same principle or learned behavior that racial intolerance and
views of violence are perpetuated and exchanged from generation to
generation.
By educating our young pertaining to education in
spiritual diversity, this in itself would cut away spiritual
extremism and promote individualism at the same time.
Of course, fair time should be given to Darwinism and
other scientific disciplines as since is the finite study to all
things spiritual in the psychical manifest. It's about giving our
children options for mental growth and freeing them from long held
dogmas that are failing or don't work.
The question we must ask ourselves: Will we allow
horrendous things to continue in the name of religion or religious
extremism, or will we teach our children to to explore the endless
possibilities of spiritual interaction and pursuit, thinking for ones
self and holding responsibility and accountability for what they
think, say and carry’s out against their neighbors, this is the key
issue here.
I would say that Dogma is the archenemy of free thinking
or psychological growth, what do you think?. I do believe in a higher
power yet, I also believe that we should be realistic in tuning up
our problem solving skills through reason and deduction. Why should
anyone or anything give us the answers to everything and take away
all the fun of experiencing life as it is.
Another point that I'd like to mention is in that as the
lack of spiritual values, moral guidance and leadership on occasion,
we have become a lost nation to our own devices however, and again,
it's not a lost cause as it all starts with a societal value and
merit system passed down to our young.
Religion, unlike a open faith system to where a person
can grow through assimilation and free thinking, religion in itself
can be a dangerous thing that promotes short sightedness,
misunderstanding, intolerance, hate, violence and death via cashing
ideologies and the failing to meet each other half way.
It is through these extremest and twisted views of a set
belief system that intolerance and violence occurs as can be cited
cases after case all over the world. Why? because religious structure
and belief systems can be defined in numerous or countless ways even
though they are steeped in dogma.
The next time religion comes up in the conversation,
please recognize it as a ideology and faith based system NOT TO DIE
for. A system built on a certain set of principles, moral and
standers that one chooses to live according to, like anything in
life. To die in the name of religion is abstract to what that
religion is trying to convey.
It's all most like fighting and dieing over “Gone with
the wind” because someone else didn't like the text and said
something nasty about it. Faith and over all religion if legitimate
is about life and not death. It's about growing a a people and being
good for and to one another and nothing to do with conflict.
Yet, like all ideologies or ideas,
they change as the person changes, nothing to get up set about,
nothing to die over, not an excuse to harass or harm your neighbor,
not a good excuse to impose your beliefs on another. Religion isn't
an excuse to persecute, beat up, harass, dominate, control or kill,
Did you hear that world? I hope so, for Heavens sake.
This means anyone proclaiming themselves to be of a
spiritual nature really shouldn't be out there making statements such
as “ I'm on a mission from God”, or “ I represent God” or “I
love Jesus” while in the same breath bashing someone else because
of their sexual preference, race, gender, religion or political
association as this is contrary to spiritualism in every way.
Yes, we are afforded the rights to peaceable assemble,
or even to protest against a certain issue yet, to protest someone
else s funeral on the grounds of a one time held sexual preference,
is down right disrespectful and disgraceful.
Further, has nothing to do with Divinity or spiritual
values especially should you believe that God is perfect in every way
and not capable of shout sightedness, or capable of mistakes etc. In
the matter of burning any holy text, the same premise applies.
Two
Voices In 300 Million
We are only two voices in 300 million calling for change
and reformation in a country that we love so much. I'm sure, there
are many out there that would find fault with our suggestions yet, we
live in strange times and our country is in parallel as a result of
many things occurring both domestically and abroad.
We are only two people that have been watching the
decline of a great nation for years that moreover feel, that we as a
part of that nation shouldn't go whimpering off into the night due to
not venting our concerns, or in offering our constrictive criticisms.
Were not political annalist or experts, and wouldn't
know the political right from the left, nor are we proficient in the
laws of the constitution or general laws therein however, we are
effected immensely like you, when others abuse our laws and rights as
American citizens.
We feel that our voices as a nation need to be heard in
one collective and resounding voice in order to reverse the harm that
has occurred In this country over the years. Were not professional
writers nor do we lobby or take part in any organization in
government yet, we have serious concerns about the nations future
along with our own.
You don't have to be a political annalist to see what's
going on in this country no more then being a professional writer,
new caster or someone holding a office, just someone trying to make
it in the world is all it requires. Many of the things we've stated
in the ways of suggestion is just that, a suggestion.
A suggestion or idea that can be built on, a concept
that can be improved upon, a statement that can be pondered and
possibly refined and made better.
Many of these suggestions above address serious issues,
some of these suggestions may be considered extreme in nature, but
the problems we endure at this time are just as extreme. Some times
extreme situations require something just as extreme in the way of
resolution.
Dogma is the great enemy of change and change is the
slayer of outmoded ways that no longer work in whatever area. This is
a call in learning from the past to prevent us in repeating that
negative past in the future days to come.
Were all cut from the same cloth, we are the family of
humanity striving towards the common goal being liberty and the
pursuit of happiness. Let's remember our fallen in battle all they
way back to the beginning, and what these courage men and women whom
freely gave up their lives in the pursuit of liberty. Ask yourselves,
are we doing them justice in honoring their memories?
The freedoms that we take for granted are the same
freedoms that were paid dearly for in American blood upon every
battlefield, from the killing fields of Europe to the blood soaked
grounds of Gettysburg and thus, are we honoring their memories in the
right way? Were their deaths in vain?
Are we remembering those whom fell so gallantly during
World War II, Korea, Vietnam and Desert Storm? and what they were
fighting for? wasn't it something about freedom and human rights? A
nation honors its fallen by guarding the dream that the solder fought
and died for and thus, are we honoring their memory in a way that
pays tribute to these fallen Heroes?
And what about the Heroes who perished in the Trade
Towers, how will we honor their memories? Do you really think
building a iron ship in their memory is really what they would have
wanted? Were they not Americans one and all whom bought into the
American dream.
Do we not have a oblation to keep their memories alive
by honoring them in a way that keeps America strong and proud? We do
this by spitting in the face of adversity and terrorism by remaining
a sovereign nation whom further respects every aspect of the
Constitution.
Yes, we as a nation have many things to think about past
all the complaining and nasty behavior, don't you think? Like I've
said before, It's not so much where we wake up and find ourselves
standing so much as it matters where we choose to go from there.
Does finger pointing really matter? Or who did what to
who after a while. Doesn't it matter more to unite, put our
differences aside and solving our problems together.
I hope we make the right choices in the future days to
come as we don't need the second fall of Rome here in America. Like I
said before, it will take a lot of sacrifice, hard work and
selflessness to bring America back to what it once was.
It will take free thinking out side of the box to lead
us out of these turbulent times. America is still here and it hasn't
gone anywhere however, she needs a overhaul here and there, it's a
small matter once we put our combined efforts in fixing these issues.
